1. Scope
These terms and conditions apply to all products and services provided by The Plastic Card Shop Limited (TPCS) and its subsidiaries (including ecocard). TPCS is a company registered in England & Wales (No: 04017072), with its registered head office at Kemps Place, Selborne Road, Greatham, Liss, GU33 6HG.
2. Price Quotations
Quotations are provided based upon TPCS understanding of the customer requirements and the current costs of production; all quotations are normally valid for a period of 30 days unless otherwise advised by TPCS in writing.
TPCS will make every effort to avoid price changes; although all prices are subject to amendment until confirmation of requirements and placement of order by the customer.
3. Value Added Tax (V.A.T.)
TPCS will apply the appropriate rate of UK value added tax to the cost of all quotations and orders at the date of invoice, TPCS cannot be held responsible for any changes in the prevailing VAT rates to be applied.
4. Specifications and Acceptance of Proofs
TPCS will manage the complete production process to ensure customer satisfaction, although the customer shall be responsible for ensuring the accuracy and quality of all information and copy data provided to TPCS.
In the event of card personalisation all fonts, names, sizes and ratios need to be disclosed to TPCS especially in respect of barcode generation. All personalisation data needs to be checked prior to submission to TPCS.
TPCS will not reformat or correct any data and the cards will be printed with the data supplied in its original format. Test cards with barcodes and/or magnetic stripes need to be checked on the final customers system and approval given to TPCS prior to final card personalisation. Please allow enough time for this testing exercise. Your TPCS account manager will advise you of sample lead times.
Prior to commencing production, proofs of all work will be provided by TPCS for the customer's approval. Whilst TPCS will ensure quality and accuracy are in accordance with customers’ specifications, the customer will remain fully responsible for validating all appropriate details including any artwork, colours, spelling and fonts.
Please note that if the order is a re-print and requires an exact colour match to a previous order, the customer will be required to supply an actual card as a sample to ensure a satisfactory colour match can be achieved.
TPCS will not accept liability for any errors not corrected by the customer at this stage and additional charges may be made for any further amendments or proofs, requested by the customer after acceptance.
5. Payment Terms, Cancellation of Orders & Refunds
Payment should be made with placement of order; once payment has been received TPCS will start processing the order.
In the event of customer cancellation after placement of order but prior to approval of proofs, a refund of 50% of the total order value will be applied.
Once proofs have been confirmed by the customer and TPCS has started the production process, cancellation of orders will not be possible and no refunds can be applied.
6. Delivery Service
Unless otherwise stated, all TPCS proposals are inclusive of standard delivery charges within the UK mainland, via traceable courier. The standard TPCS delivery service provides next day delivery, Mondays to Fridays, before 17:30 hrs, to a single UK address.
Express same-day delivery service can be provided if required, although this will be subject to an additional charge; deliveries before 12:00, or before 09:00, can also be arranged.
It is the customer's responsibility to provide accurate and complete information of their delivery requirements, so these can be properly achieved. Individual and special delivery requirements can be accommodated, although may incur additional courier charges which will be passed on to the customer.
In the event that the customer is unable to receive delivery at the specified address when attempted by the courier within the agreed timescales, delivery will deem to have been completed at that point and it is the customer's responsibility to make revised delivery or collection arrangements with the courier.
TPCS cannot be held responsible for any additional delays or costs associated with re-deliveries.
7. Lead-times
Delivery lead-times will be as stated on the TPCS estimate and are subject to sight of artwork and customer approval of proofs. TPCS will make every effort to ensure that all work is satisfactorily completed and successfully delivered within these timescales, according to customer requirements and Cardmarque quality standards.
8. Copyright
The customer shall retain ownership of all copyright of data submitted, but will grant TPCS a royalty-free, non-terminable licence to use in order to fulfill the requirements of customer orders.
Unless expressly requested not to do so by the customer, TPCS reserves the right to use any artwork images from completed orders to promote itself. TPCS will, as a matter of courtesy, request the approval of the customer before proceeding, although such approval is not to be unreasonably withheld.
The customer shall be fully responsible for obtaining the necessary approvals to enable TPCS to reproduce all images and artwork it supplies, and shall indemnify TPCS against any third party claims associated with the use of such images. TPCS will not provide customers with any products which may be of an illegal or libelous nature or a potential infringement of the proprietary rights of any third party.
The copyright in the material contained in the TPCS websites, together with the website design, text and graphics, and their selection and arrangement, and all software compilations, underlying source code and software belongs to TPCS, its subsidiaries or the providers of such information. All rights are reserved. None of this material may be reproduced or redistributed without TPCS prior permission.
9. Branding & Trademarks
Unless specifically requested not to do so by the customer, TPCS may include its’ own brand logos and other trademarks as appropriate. These will be included in the final proofs and subject to customer approval; they are intended to promote and validate the authenticity of the products.
All logos, names, images and trademarks of TPCS and its subsidiaries are proprietary rights of the TPCS group; the use of any such logo, name, image or trademark is not permitted without our prior written permission.
10. Data Protection
TPCS warrants that all customer information provided in the placement and fulfilment of orders will be retained by TPCS in a secure environment, information will not be provided to third parties outside the TPCS group or its agents.
11. Claims
Advice of damage, delay, non-delivery or partial loss of products should be given to TPCS within 3 working days of the actual delivery date. Any claims should be made in writing within 28 days of delivery.
TPCS will make every effort to ensure that customer requirements are fully satisfied but will not be held liable for any customer claims unless the agreed specifications have not been adhered to as is reasonably possible.
In any case, the total liability of TPCS in respect of any claims from customers for non-fulfillment of orders, shall be limited to the total value of the appropriate order.
12. Warranties
Whilst it will use its best endeavours and extensive knowledge of plastic card products and their applications to ensure that customer requirements are fully satisfied, TPCS does not provide any warranties or guarantees of any kind relating to the suitability of its products for a particular purpose.
TPCS shall use all reasonable efforts to ensure that the best possible colour and image reproduction on customer's work is achieved, although some variation is inevitable during the production process and an exact match cannot be guaranteed.
TPCS will not accept any liability in respect of any unsatisfactory quality or poor performance as a result of incorrect or incomplete information specified by the customer.
TPCS not shall not be liable for any indirect costs, consequential damages, loss of profits, goodwill or data associated with the performance of its products or resulting from delays in delivery.
13. Force Majeure
TPCS will not accept any liability if it is unable to meet its obligations to the customer for any reason outside its control including (but not limited to); acts of god / natural disasters, governmental legislation, war, power failures, industrial action by agents & third parties.
In the event of such an occurrence, TPCS will use its best endeavours to satisfy the delivery requirements as soon as it is able, although the customer will have the option to terminate the contract and pay for work completed and costs incurred by TPCS until that point.
14. Jurisdiction and Changes
These terms and conditions shall be governed by and construed in accordance with English law. They may be amended from time to time without notice; the latest version of these terms can be accessed via the TPCS website.
